409(A) and (B) Deferred Compensation Plans are different than a typical retirement type plan such as a 401(K) plan or 403(B). The409(A)legislation latest revisions are 397 pages long. These types of plans need expert guidance and careful attention when doing a rollover or transfer.

If the arrangement does not the requirements of 409(A), the compensation is subject to certain additional taxes, including a 20% additional income tax. 409(A) has no effect on F.I.C.A. (Social Security and Medicare) tax.
